Acceptance of Terms

By accessing or using Vidlark (the "service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the service.

Description of Service

Vidlark is an online service that generates videos and images with AI models from the prompts and images you provide. We may modify, suspend, or discontinue any part of the service at any time, with reasonable notice where possible.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use or security breach.

Acceptable Use Policy

You agree not to:

• Violate any applicable laws or regulations.
• Attempt to gain unauthorized access to our systems or data, or get around our safety checks.
• Interfere with or disrupt the integrity or performance of the service.
• Use the service to send spam, malware, or other harmful content, or to run fraud or mass automated abuse.

Prohibited content

You may not use Vidlark to generate, upload or share content in any of these six categories:

1. Sexual content and nudity (NSFW). Pornography, sexually explicit or nude images and videos, and sexual requests of any kind.
2. Violence and gore. Graphic violence, gore, torture, self-harm, or content that promotes or glorifies violence against people or animals.
3. Hate speech. Content that attacks, demeans or incites hatred or violence against people based on race, ethnicity, nationality, religion, gender, sexual orientation, disability or similar traits.
4. Child safety (CSAM). Any content that sexualizes minors or depicts child sexual abuse. We have zero tolerance for this and report it to the relevant authorities.
5. Deepfakes and impersonation. Content that uses a real person's face, body or voice without their consent, intimate imagery of real people, or content that impersonates a person, brand or institution to mislead others.
6. Copyright and trademark infringement. Content that copies or uses someone else's copyrighted work, characters, logos or trademarks without permission.

Also prohibited: terrorist or violent extremist content, instructions for weapons capable of mass harm, misinformation meant to deceive, and presenting AI-generated content as real footage of real events or people.

AI-generated content

All videos and images produced on Vidlark are generated by AI models and are labeled as AI-generated on the service. You are responsible for how you use and share them. You only upload images, videos and other material that you own or have the right to use, and you do not upload photos of another person without their permission.

How we moderate content

• Before a generation starts. Every prompt is checked automatically before any credits are charged. Requests for sexual content, and anything that sexualizes minors, are blocked.
• During generation. The AI models we use apply their own safety filters to prompts, uploaded images and results, and refuse content that breaks their policies. A blocked or refused generation is refunded in credits.
• Human review. Our team reviews every report we receive and may review the generations and account linked to it.
• Enforcement. Depending on how serious the violation is and whether it has happened before, we may block the request, remove the content, warn you, or suspend or close your account without a refund. Child sexual abuse material and terrorist content lead to immediate account closure and a report to the authorities.

Reporting content

If you see content or behavior on Vidlark that breaks these rules, or content that infringes your rights or uses your likeness, email support@vidlark.ai with the subject "Content report", a link to or description of the content, and why you are reporting it. Intellectual property complaints should also say which work or mark is affected and that you own it or are authorized to act for the owner.

We review every report and handle child-safety and other urgent reports first. Reports are kept confidential, and we do not share the reporter's identity with the person reported. Knowingly false or abusive reports may lead to action against the reporting account.

Payments and Merchant of Record

Paid plans and credit packs are billed in advance for the selected billing period or as a one-time purchase. Prices are shown before you pay. Depending on the checkout you use, your payment is handled by one of two providers:

• Waffo Pancake. Orders placed through our Waffo Pancake checkout are processed by our online reseller & Merchant of Record, Waffo Pancake, who also handles order-related inquiries and returns. As Merchant of Record, Waffo Pancake (operated by Waffo.com Limited) collects the payment, issues the invoice or receipt, calculates and remits applicable sales tax or VAT, and settles the proceeds with us.
• Stripe. Orders placed through our Stripe checkout are processed by Stripe, which handles the card payment on our behalf; in that case Vidlark is the seller.

You are responsible for providing accurate billing information. Subscriptions renew automatically until you cancel; after you cancel, your plan stays active until the end of the period you paid for.

Refunds

You can ask for a full refund within 14 days of a payment if none of the credits from that payment have been used and nothing has been generated with that plan, including free models on Unlimited. Once used, a payment is not refundable. For subscriptions this applies to the first payment and to each renewal separately; cancelling stops future renewals and the plan stays active until the end of the paid period. Duplicate charges, or payments whose credits never arrived, are refunded in full at any time. Failed generations are refunded in credits automatically. To ask for a refund, email support@vidlark.ai; refunds go back to the original payment method in 5–10 business days.

For orders placed through Waffo Pancake, Waffo Pancake processes the refund as Merchant of Record and can also be contacted about the order directly.

Intellectual Property

The service and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws. Subject to these terms and to the rights of others in the material you upload, you may use the results you generate.

Termination

We may suspend or terminate your access to the service at any time if you violate these terms. You may close your account at any time through your account settings.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the service.

Changes to These Terms

We may modify these Terms at any time. We will notify users of any material changes by updating the date at the top of this page and, where appropriate, sending a notice through the service.
